Immediate Steps After a Road Traffic Accident

If you are involved in a road traffic accident in Ireland, it is important to remain calm and follow the correct steps.

  1. Stay at the scene – Leaving the scene of an accident without taking the required actions may be an offence.
  2. Exchange details – Share your name, contact details, insurance information, and vehicle registration with the other party.
  3. Call the Gardaí – If Gardaí do not attend the scene, you should report the collision at your local Garda Station as soon as possible.

Under the Road Traffic Act, drivers have a legal obligation to report collisions to An Garda Síochána, even if the incident seems minor.

When You May Need Legal Advice

Depending on the circumstances of the accident, you may be asked to provide a statement to the Gardaí. Before doing so, it is strongly recommended that you seek advice from an experienced road traffic law solicitor. Legal advice can protect your rights and ensure that your interests are properly represented.

Common Offences That Arise From Road Traffic Collisions

Some of the most common offences linked to car accidents include:

  • Driving without reasonable consideration (S. 51A RTA)
  • Careless driving (S. 52 RTA)
  • Dangerous driving (S. 53 RTA)
  • Driving without insurance (S. 56 RTA)
  • Failing to remain at the scene of an accident
  • Failing to report an accident to Gardaí
  • Drink driving
  • Drug driving

Each of these offences carries potential penalties including fines, penalty points, disqualification from driving, or in serious cases, imprisonment.

Next Steps If You Receive a Summons

If you have been issued with a court summons following a road traffic accident, you should seek legal advice immediately. Having an experienced solicitor by your side can make a significant difference in preparing your case and representing your interests in court.
